Welcome to Growthfyt ("Company", "we", "our", "us")! These Terms of Service ("Terms", "Terms of Service") govern your use of our website and services (collectively, the "Service") operated by Growthfyt.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Definitions

Service: The Growthfyt platform, which provides automated prospect discovery, email verification, and outreach capabilities.

User: An individual or entity who has created an account with Growthfyt.

Subscriber: A User who has subscribed to one of Growthfyt's paid plans.

Content: Any data, text, information, or material that Users submit to the Service.

3. Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription Plans

Growthfyt offers various subscription plans with different features and capabilities. By selecting a paid subscription, you agree to pay the subscription fees indicated for that service. Payments will be charged on the day you sign up for a subscription and will cover the use of that service for the period indicated.

Subscription fees are non-refundable. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

5. Acceptable Use

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• To violate any applicable local, state, national, or international law or regulation.
• To send unsolicited or unauthorized advertising, promotional materials, or spam.
• To harvest or collect email addresses or other contact information of others for the purpose of sending spam or other commercial messages.
• To impersonate or attempt to impersonate Growthfyt, a Growthfyt employee, another user, or any other person or entity.
• To engage in any conduct that restricts or inhibits anyone's use of the Service, or which may harm Growthfyt or users of the Service.

6. Data and Email Usage Limitations

Our subscription plans include limitations on prospect discoveries, verified emails, and other features. These limitations reset on a monthly basis. Exceeding these limits may result in additional charges or temporary suspension of certain features until the next billing cycle.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Growthfyt and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Growthfyt.

8. User Content

You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your User Content in any existing or future media.

You represent and warrant that your User Content does not violate third-party rights, including privacy, publicity, copyright, trademark, and other intellectual property rights.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Limitation of Liability

In no event shall Growthfyt, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

12. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
